Since they never pursed RPG, they may have decided to let the issue go. They would have looked pretty inept sending an authentic C&D to them after someone had sent a forged one, as if they only noticed RPG because of it. Also, think about how the story would have snowballed. People were already signing petitions and blogging about it.
